1. Scope of Application
- These General Terms and Conditions ("GTC") apply to all contracts concluded via the online shop www.schafhocker.com between us and our customers.
- The range of goods is directed at consumers and entrepreneurs. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor attributable to their independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their commercial or independent professional activity.
- Deviating conditions of entrepreneurs shall only become part of the contract if we have expressly agreed to their validity in text form.

3. Offer, Order and Conclusion of Contract
- The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to you to submit an offer to purchase. Product descriptions, illustrations, dimensions, colors, and material specifications serve to describe the goods.
- You can place the desired goods in the shopping cart without obligation. Before submitting the order, you can check and correct the information at any time using the standard functions of the ordering process.
- By clicking the button that concludes the ordering process, you submit a binding offer to purchase the goods in the shopping cart.
- The receipt of your order will be confirmed by an automated email. This confirmation of receipt merely documents the arrival of your order and does not yet constitute an acceptance of your offer.
- A contract is only concluded when we expressly accept your offer by way of an order confirmation or when we dispatch the ordered goods to you. If we cannot accept your offer, we will inform you immediately; any payments already made will be refunded in this case.
- We store the text of the contract and send you the order data as well as these GTC with the order confirmation in text form. You can view and save the GTC in the online shop at any time.
4. Products and Handmade Individual Pieces
- Our products are entirely or partially handmade and consist partly of natural materials. In the case of handmade products and natural materials, customary or production-related, reasonable deviations, particularly in color, structure, grain, hide pattern, shape, dimensions, and weight, may occur, provided that the agreed quality and usability are not impaired thereby.
- Statements regarding availability, deliverability, and production time refer to the time of display in the online shop. Should a specific ordered piece not be available despite careful inventory management, we will inform you immediately and refund any payments already made without delay.
- The specifications in the respective product description at the time of the order are decisive for the quality of the product. Guarantees are only assumed if they are expressly designated as such.
5. Prices, Currencies, Taxes, Shipping Costs and Import Duties
- The prices specified in the online shop are stated in Euro. Depending on your selected delivery country, your shop language, and the Shopify Market settings, our online shop may additionally display prices in different currencies. The total price, including taxes and duties shown in the checkout, which is displayed to you immediately before submitting your order, is always decisive.
- Insofar as value added tax (VAT) is owed for the delivery, this will be taken into account in the checkout in accordance with the respectively applicable tax regulations. For deliveries to consumers within the European Union, VAT is calculated according to the applicable tax regulations of the delivery country and, if the requirements are met, remitted via the EU One-Stop-Shop (EU-OSS).
- Intra-Community supplies to entrepreneurs: Entrepreneurs based in another member state of the European Union can place an order in the online shop without Austrian VAT, provided they provide a valid VAT identification number (VAT ID) during the ordering process and this number is successfully verified. A prerequisite for a tax-free intra-Community supply is also that the goods actually reach another EU member state from Austria, that the acquisition by the customer in the destination country is subject to acquisition taxation, and that all statutory evidence and reporting obligations are met. If these requirements are not met or not fully met – in particular in the case of an invalid VAT ID, lack of proof of the movement of goods, or a delivery within Austria – the statutory VAT owed will be charged. In the case of a tax-free intra-Community supply, the invoice will be issued with a reference to the tax exemption. The entrepreneurial customer is responsible for the proper taxation of the intra-Community acquisition in the destination country.
- We deliver worldwide free of shipping costs, unless expressly stated otherwise in the checkout or on the respective product page.
- For deliveries to countries outside the European Union, customs duties, import VAT, local taxes, customs clearance fees, or other import charges may apply. These charges are levied by the competent authorities or service providers of the destination country and are to be borne by the recipient. They are not included in our prices unless expressly stated otherwise in the checkout.
- You are responsible for informing yourself about the import, customs, and entry restrictions applicable to the delivery country. We assume no responsibility for a shipment being admitted due to local import regulations, provided the cause lies outside our sphere of influence.
- In the event of payment in a currency other than Euro, the payment service provider or the card-issuing bank may perform a currency conversion. Any conversion or bank fees are outside our sphere of influence.
6. Payment Methods and Due Date
- The respective available payment methods are displayed to you in the checkout and may vary depending on the delivery country, order value, and availability.
- Insofar as available in the checkout, payments can be made in particular via credit or debit card (Visa, Mastercard, American Express, Maestro, UnionPay) as well as via Bancontact, EPS, iDEAL/Wero, Klarna, MobilePay, or TWINT.
- Payment processing is carried out via Shopify Payments and/or the respectively selected payment service. The terms and conditions of the payment service provider you have chosen apply complementarily.
- The purchase price is due upon conclusion of the contract, unless otherwise stated in the checkout or for the selected payment method. In the event of non-availability for which we are responsible, any amount already paid will be refunded immediately.
7. Delivery, Delivery Times and Transfer of Risk
- We deliver worldwide to the delivery addresses selectable in the checkout. Delivery to packing stations (Packstationen), parcel depots, or similar pickup stations is currently not possible.
- The delivery time applicable to a product is shown on the product page or in the shipping information before the order is concluded and is decisive for the contract. Unless otherwise stated for the respective product, the following standard delivery times apply:
- In-stock products: usually 5–7 business days from the conclusion of the contract.
- Handmade custom items: usually 10–15 business days from the conclusion of the contract.
- The stated times take into account production and standard shipping. For international deliveries, additional transit times outside our sphere of influence may occur, in particular due to customs clearance, local delivery partners, weather conditions, or official measures. We will inform you immediately of any foreseeable significant delays.
- Insofar as a binding delivery date is required or the pre-contractually specified delivery period cannot be met, the statutory rights of the consumer remain unaffected. For consumers, the following applies in particular: Unless a different delivery period has been agreed, we deliver without unnecessary delay and generally at the latest within 30 days after the conclusion of the contract.
- The risk of loss or damage to the goods passes to consumers only when the goods are handed over to the consumer or a third party designated by them who is not the carrier. For entrepreneurs, the risk passes to the entrepreneur upon handover to the shipping service provider.
- Partial deliveries are permissible provided they are reasonable for you. You will not incur any additional shipping costs as a result.
8. Retention of Title
The goods remain our property until full payment of the purchase price.
9. Right of Withdrawal for Consumers and Online Withdrawal Function
- Consumers with their habitual residence in the European Union are generally entitled to a statutory right of withdrawal of 14 days for distance contracts. The details, requirements, consequences of withdrawal, as well as the model withdrawal form, can be found in our separate withdrawal policy, which is made accessible before submitting the order, at: https://www.schafhocker.com/policies/refund-policy
- For purchase contracts, the withdrawal period generally begins on the day on which you or a third party designated by you, who is not the carrier, took possession of the goods. In the case of partial deliveries, it begins upon receipt of the last goods.
- The right of withdrawal does not exist for goods that are manufactured according to customer specifications or are clearly tailored to personal needs. Mere manual production, small series, or limited availability does not automatically lead to the exclusion of the right of withdrawal. The exclusion only applies if the specific goods were actually manufactured according to your individual specifications or clearly personalized.
- You can additionally exercise your right of withdrawal via our online withdrawal function. This can be reached at: https://www.schafhocker.com/policies/refund-policy. The online withdrawal function is clearly marked as "Withdraw from Contract". After selecting the relevant order or goods and submitting the required information, you can send your declaration of withdrawal via the "Confirm Withdrawal" button.
- After receipt of a withdrawal submitted online, we will immediately send you a confirmation of receipt on a durable medium, usually by email. The confirmation contains the content of your declaration of withdrawal as well as the date and time of receipt. It only confirms the receipt of the declaration and does not yet constitute a statement regarding the existence or non-existence of a right of withdrawal in the individual case.
- The use of the online withdrawal function is voluntary. You can still declare your withdrawal by other means, for example by email or by using the model withdrawal form.
- Costs of return: You shall bear the direct costs of returning the goods, unless we expressly offer you a free return label or a free pickup. Since some of our products, due to their nature, size, or weight, cannot always be returned normally by post, the return costs depend on the country of collection or delivery. For better predictability, we limit the amount to be borne by you as follows:
- Austria: maximum 20 Euro
- European Union: maximum 50 Euro
- Switzerland and United Kingdom: maximum 75 Euro
- Rest of Europe: maximum 75 Euro
- North America: maximum 260 Euro
- Rest of the world: maximum 300 Euro
- For consumers with their habitual residence outside the European Union, the statutory consumer protection rights of their state of residence apply, insofar as these are mandatory. A statutory right of withdrawal under Austrian distance selling law may be restricted or not applicable in these cases.
- Your statutory warranty rights remain unaffected by an exclusion or non-existence of the right of withdrawal.
10. Warranty and Rights in Case of Defects
- Statutory warranty rights apply. For consumers, these rights are not restricted by these GTC.
- Please check the goods for recognizable transport damage after receipt. Please report obvious transport damage to the deliverer and to us as soon as possible. Failure to report has no effect on your statutory warranty rights.
- For entrepreneurs, the statutory inspection and notification obligations under the Austrian Commercial Code (UGB) apply, insofar as applicable.
11. Liability
- We are liable without limitation for damages caused by intent or gross negligence, in the event of culpable injury to life, limb, or health, under the Product Liability Act, and within the scope of a guarantee expressly assumed by us.
- In the event of a slightly negligent breach of essential contractual obligations, we shall only be liable for the contract-typical, foreseeable damage. Essential contractual obligations are obligations whose fulfillment makes the proper execution of the contract possible in the first place and on whose compliance you may regularly rely.
- Otherwise, our liability for slight negligence is excluded. Mandatory statutory claims, in particular claims of consumers, remain unaffected.
12. Image and Copyrights
The content published in the online shop, in particular product photos, texts, graphics, logos, and design elements, is protected by copyright or other protective rights. Any use outside the statutory limits, in particular reproduction, editing, distribution, or making available to the public, requires our prior written consent or the consent of the respective rights holder.

14. Applicable Law and Jurisdiction
- Austrian law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the state in which they have their habitual residence.
- Statutory places of jurisdiction apply to consumers. An exclusive jurisdiction agreement in favor of an Austrian court is not made with consumers.
- If the customer is an entrepreneur, the court having subject-matter jurisdiction at the registered office of DokuPit GmbH in Amstetten shall have exclusive jurisdiction for all disputes arising from or in connection with the contractual relationship. However, we are also entitled to assert claims at the entrepreneur's general place of jurisdiction.
15. Final Provisions
- Should a provision of these GTC be or become invalid, unfeasible, or unenforceable in whole or in part, the validity of the remaining provisions shall remain unaffected. The invalid, unfeasible, or unenforceable provision shall be replaced by the statutory regulation.
- Changes or amendments to these GTC must be in text form to be effective, unless a stricter form is prescribed by law. This does not apply to individually made agreements.
